DMCA COPYRIGHT POLICY
bUltima (“The Bulgarian Ultimate League, “Company“) has adopted the following general policy toward copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA“). The address of the Designated Agent to Receive Notification of Claimed Infringement (“Designated Agent“) is listed at the bottom of this page. Please note that if you fail to comply with all of the requirements below, your DMCA notice or counter-notification may not be processed.
Reporting Copyright Infringement:
BUltima will promptly remove materials from its websites and services in accordance with the DMCA if properly notified that the materials infringe a third party’s copyright. If you believe that material residing on or accessible through bUltima’s websites or services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below:
- Your contact information, including address, telephone number and, if available, your e-mail address;
- Identification of the works or materials being infringed;
- Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that bUltima is capable of finding and verifying its existence (e.g. the URL);
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement made under penalty of perjury that the information provided is accurate and you are authorized to make the complaint on behalf of the copyright owner; and
- Your physical or electronic signature.
UNDER SECTION 512(f) OF THE COPYRIGHT ACT, 17 U.S.C. § 512(f), ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL OR ACTIVITY IS INFRINGING MAY BE SUBJECT TO LIABILITY.
Counter-Notification
If you believe that your material has been removed due to mistake or misidentification, please provide a counter-notification containing the following information to the Designated Agent listed below:
- Your contact information, including address, telephone number and, if available, your e-mail address;
- Identification of the material that was removed with sufficient detail so that BUltima is capable of finding it and verifying its existence (e.g. the URL);
- A statement made under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, any judicial district in which bUltima operates (including the United States District Court for the Southern District of New York), and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person; and
- Your physical or electronic signature.
UNDER SECTION 512(f) OF THE COPYRIGHT ACT, 17 U.S.C. § 512(f), ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL WAS REMOVED OR DISABLED BY MISTAKE OR MISIDENTIFICATION MAY BE SUBJECT TO LIABILITY.
Your counter-notification will be forwarded to the person who submitted the original notice of infringement. If bUltima does not receive notice that a lawsuit for copyright infringement has been filed against you within ten (10) business days after the forwarding of your counter-notification, we will restore the removed materials. Until that time, your materials will remain removed.
